Please note: The garages are off-limits, but there is ample parking available on the property for your convenience. Property Amenity Waiver and Release of Liability Agreement (Hot Tub, Playground/Swing Set, and Conservation Trail Use) This Waiver and Release of Liability Agreement (the “Agreement”) is entered into by and between the property owner (the “Owner”) and the guest(s) making the reservation (collectively, the “Guest”) at the rental property (the “Property”). This Agreement applies to the use of the Hot Tub, Children’s Playground & Swing Set, and Swamp Conservation Trail. 1. HOT TUB WAIVER Acknowledgment of Risks: The Guest acknowledges that use of the hot tub involves inherent risks, including but not limited to slips, falls, drowning, overheating, and potential reactions to hot tub chemicals. All risks, known or unknown, are voluntarily assumed by the Guest. Conditions of Use: Guests under the age of 18 must have direct adult supervision. Guests with medical conditions (e.g., pregnancy, heart issues, skin sensitivities) should consult a physician prior to use. Guests agree to follow all posted safety rules and never use the hot tub alone. No glass containers are allowed in or near the hot tub. The hot tub cover must be replaced after each use. Hot tub use should be limited to 15-minute intervals to avoid overheating. No lotions, oils, or soaps should be used before entering the hot tub, as they disrupt water chemistry and damage filters. Alcoholic beverages should not be consumed before or during use due to the risk of intensified effects and unconsciousness. Release of Liability & Indemnification: The Guest releases and waives any and all claims against the Owner, and agrees to indemnify and hold harmless the Owner for any injury, harm, or damages resulting from the use of the hot tub by the Guest or their invitees. 2. CHILDREN’S PLAYGROUND & SWING SET WAIVER Acknowledgment of Risks: The Guest understands that use of the playground and swing set involves physical activity and risks including, but not limited to, falls, collisions, or equipment malfunction. Conditions of Use: Children under 14 must be supervised by a responsible adult at all times. All equipment must be used only as intended. No rough play, jumping from swings, or climbing on non-climbable structures. The Owner makes no guarantees regarding the condition or safety of the equipment. Use is at the Guest’s own risk. Release of Liability & Indemnification: The Guest agrees to release, waive, and hold harmless the Owner from all claims, damages, or losses arising from the use of the playground and swing set. 3. SWAMP CONSERVATION TRAIL WAIVER Acknowledgment of Risks: The Guest acknowledges that the conservation trail behind the property is a natural, unmonitored area with potential hazards including mud, uneven terrain, insects, wildlife, and overgrown vegetation. Risks include slips, falls, allergic reactions, and encounters with animals or plants. Conditions of Use: Access is at the Guest’s own risk. Guests should wear appropriate footwear and clothing. Trail access is limited to daylight hours only. Guests must stay on visible paths and avoid disturbing natural areas. The Owner does not guarantee maintenance or monitor trail conditions. Release of Liability & Indemnification: The Guest releases and agrees to indemnify and hold harmless the Owner for any claims, injuries, or losses sustained while using the trail. Acknowledgment & Acceptance By using the hot tub, playground/swing set, or swamp trail during their stay at the Property, the Guest confirms that they have read this Agreement, fully understand its contents, and voluntarily accept the risks and terms stated herein.
